TowME Namibia Terms and Conditions

Welcome to TowME Namibia. These Terms and Conditions govern your use of the TowME Namibia mobile application, website, and related services. By accessing or using our Platform, you agree to comply with and be bound by these Terms.

1. About TowME Namibia

TowME Namibia is a digital platform that connects users with roadside assistance providers, towing operators, and related service providers.

We do not directly provide towing or roadside services unless explicitly stated. We act as an intermediary between users and independent service providers.

2. Eligibility

To use TowME Namibia, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter into binding agreements
  • Provide accurate and complete information during registration

3. User Accounts

  • You are responsible for maintaining the confidentiality of your account details
  • All activity under your account is your responsibility
  • TowME Namibia reserves the right to suspend or terminate accounts for misuse or fraudulent activity

4. Services Provided

TowME Namibia enables users to:

  • Request roadside assistance including towing, battery support, fuel support, and related services
  • Track service providers
  • Communicate with operators
  • Store service history and incident data

TowME Namibia does not guarantee:

  • Availability of services at all times
  • Response times
  • Quality of service provided by third parties

5. Service Providers

  • All towing operators and service providers are independent contractors
  • TowME Namibia does not employ or control these providers
  • Providers are responsible for their own licenses, insurance, and compliance with local laws

6. Payments and Fees

  • Users agree to pay all applicable fees for services requested
  • Pricing may vary depending on location, service type, and provider
  • Payments may be processed through the app or directly with the service provider
  • TowME Namibia may charge a service or facilitation fee
  • All payments are non-refundable unless otherwise stated

7. Cancellations

Users may cancel a request before a service provider is dispatched.

Cancellation fees may apply if:

  • A provider has already been assigned
  • The provider is en route or has arrived

8. User Responsibilities

You agree:

  • To provide accurate location and vehicle information
  • Not to misuse the Platform
  • Not to engage in unlawful, abusive, or harmful behaviour
  • To treat service providers respectfully

9. Limitation of Liability

Use of the Platform is at your own risk.

TowME Namibia is not liable for:

  • Damages caused by service providers
  • Delays, missed services, or service failures
  • Loss or damage to vehicles or personal property
  • Any indirect, incidental, or consequential damages

10. Insurance and Claims

  • Any claims related to damages must be directed to the service provider or their insurer
  • TowME Namibia may assist in facilitating communication but is not responsible for claim outcomes

11. Data and Privacy

  • We collect and process personal data in accordance with our Privacy Policy
  • This may include location data, contact information, and service history
  • By using TowME Namibia, you consent to this data usage

12. Intellectual Property

  • All content, branding, logos, and technology on the Platform belong to TowME Namibia
  • Users may not copy, modify, or distribute any content without permission

13. Platform Availability

  • TowME Namibia does not guarantee uninterrupted or error-free operation
  • Maintenance, updates, or technical issues may affect availability

14. Termination

TowME Namibia reserves the right to:

  • Suspend or terminate access at any time
  • Remove users who violate these Terms

15. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform means you accept any changes.

16. Governing Law

These Terms are governed by the laws of the Republic of Namibia.

17. Dispute Resolution

Any disputes arising from these Terms will:

  • First be attempted to resolve amicably
  • If unresolved, be referred to the appropriate courts of Namibia

19. Acceptance of Terms

By using TowME Namibia, you confirm that you have read, understood, and agreed to these Terms and Conditions.

Intellectual Property, Copyright, and Platform Protection

TowME Namibia, including its website, mobile applications, dashboards, source code, software architecture, user interfaces, dispatch workflows, route tracking flows, brand assets, name, logos, graphics, text, documentation, reports, and related materials, is owned by TowME Namibia and protected by Namibian copyright, trademark, and intellectual property laws.

TowME Namibia holds documented copyright ownership, trademark protection, and supporting certificates for its protected works and brand identity. You may not copy, clone, reproduce, scrape, reverse engineer, imitate, redistribute, resell, commercially exploit, or create derivative works from the TowME platform or any substantial part of it without prior written permission.

Any unauthorised copying, cloning, brand imitation, source-code theft, design reproduction, workflow duplication, platform scraping, or misuse of TowME intellectual property may result in legal action, takedown proceedings, damages claims, interdicts, app-store complaints, hosting-provider notices, domain complaints, and other remedies available under Namibian and applicable international law.
